Terms of Service

1. About these terms

These terms govern your use of the America Technology Services website and, unless a separate written agreement says otherwise, the services we provide. Using this site means you accept them. [CONFIRM — a signed service agreement will override these for managed clients]

2. Quotes and pricing

Prices shown for website packages are in South African Rand, exclude VAT where applicable, and are valid for 30 days from the date of a quote. Managed-IT and Health-Check pricing is provided in a fixed quote and is not a standing offer until agreed in writing.

3. Website packages

Website packages run on a 12-month minimum term, after which they may be cancelled with 30 days' notice. If you cancel within the first 12 months, the normal setup fee becomes payable. You own your content and your domain. Two rounds of changes are included before launch; further changes are billed at the published rates.

4. Scope and no-guarantee clause

We provide services with reasonable skill and care. We do not guarantee uninterrupted or error-free service, and we do not publish response-time or uptime guarantees unless they are written into your specific agreement. Where we assist with POPIA-ready IT controls, this is limited to the IT-controls side; POPIA compliance is broader and requires legal advice from an attorney.

5. Client responsibilities

You are responsible for the accuracy of information you provide, for keeping your own records, and for authorising us to access the systems we are engaged to manage. You remain responsible for lawful use of the systems we support.

6. Liability

To the maximum extent permitted by South African law, ATS is not liable for indirect or consequential loss arising from use of this site or the services. Nothing excludes liability that cannot lawfully be excluded.

7. Governing law

These terms are governed by the laws of the Republic of South Africa.

8. Changes

We may update these terms. The version on this page, with its "last updated" date, is the one that applies.
